Professor Amanda Frost comments on the recent article in the Virginia Law Review, “The Constitutional Right to Collateral Post-Conviction Review,” by Professor Carlos Vázquez and Professor Stephen Vladeck concerning the implications of the Supreme Court’s 2016 decision in Montgomery v. Louisiana. In particular, whether the Supreme Court implicitly held that some prisoners have a constitutional right to post-conviction habeas review.
