This course satisfies the Health Care Compliance Certificate. This is a two-credit experiential course with live class time compressed (i.e., front-loaded) in the first half of the semester. The first live class will be held on Tuesday, January 11, 2022 and the last live class will be held on Tuesday, March 1, 2022. During live class time, students will focus on simulations, mock client hypotheticals and oral and written communication/presentation skills. A central aspect of this course will be to prepare for and participate in the 11th Annual Health Law Regulatory & Compliance Competition hosted by the University of Maryland Francis King Carey School of Law (the hypothetical competition problem will be released on or around February 18, 2022 and students will have 24 hours to complete the prompt. Student teams will then attend a short feedback session and awards ceremony on February 26,2022). After the competition is over, students will be required to write a short paper (approximately 10 pages) on any health law topic, in lieu of a final exam. Description
This course examines fraud and abuse in the delivery of health care and the practical applications of federal and state Anti-Kickback Laws, the federal physician self-referral law (Stark), the federal civil monetary penalty and exclusion laws, and the federal False Claims Act. The intersection of fraud and abuse laws with food and drug law and medical device and pharmaceutical regulation will also be probed. All content will be studied from the perspectives of compliance, transactions, and enforcement. The in-class time for this course will be structured to be primarily experiential in nature with the emphasis on conducting simulations, analyzing mock client hypotheticals and practicing oral and written communication and presentation skills.
