Description

This seminar will focus on the role of politics in the enforcement of civil rights laws. From its establishment in 1957 through battles over school desegregation, affirmative action, protection of abortion clinics, politicized hiring, and enforcement of the Voting Rights Act to the latest dispute over the enforcement of voter intimidation laws, the Civil Rights Division of the Department of Justice has functioned at the juncture of law, policy and politics. Students will explore several areas of civil rights law and various enforcement episodes with the goal of understanding the permissible role of political considerations in influencing both policy and law enforcement decisions. Students will be expected to write a final paper.

Readings will include Civil Rights Enforcement by Brian Landsberg, as well as cases and secondary material analyzing law, politics and history. Students should purchase the Landsberg book. The remaining materials will be posted on MyWCL.
