Description

This course will give you a basic understanding of the structure of U.S. labor and employment law. It does so by focusing on the many different ways in which law regulates the employment relationship. Because the field is so vast, we do not cover important topics including employment discrimination, employee pensions and benefits, or international labor rights. These important topics are covered by other courses at WCL.

In this course, we will examine a number of statutes and case law that regulate the employment relationship. These legal frameworks reflect two main approaches to regulation of the employment relationship: employment law, which involves the protection (or lack therof) of individual employee’s rights, and labor law, which applies primarily to unionized workplaces in the U.S. and reflects a collective approach.

Employment and labor cases and regulations are in the news regularly and we will routinely discuss current events as they apply to our course materials. In addition, I recognize that a three-hour block class will serve as a weekly test of your stamina. Accordingly, we will have regular visits (virtually, in-person, or both -- depending on WCL policies) from experts who will provide additional insight into the course materials and help you to understand the practical realities of law practice in this subject area. Finally, we will also use class time to occasionally role-play/debate/field questions from the rest of the class on the issues we’ve covered so that you learn how to think through labor and employment matters and advocate from all three perspectives (employee, employer and union ).
