Description

Explores the nature and function of military justice today. Topics examined include the constitutional rights of military personnel; court-martial jurisdiction; capital punishment; trial and appellate structure and procedure; the roles of commanders, Congress, the Supreme Court, and the president; and judicial independence. Students will consider whether and how the military justice system can be improved. Using comparative law materials, they also will consider what can be learned from the experiences of other countries. There will be a take-home exam.
