A Jurisprudence in Shambles: Resolving the Supreme Court’s Tortured Treatment of Religion and the First Amendment

Description: The Establishment Clause enshrines the American ideal of separating state and religious affairs. Though seemingly straightforward, the Clause has given rise to a quagmire of overlapping tests, conflicting precedents, and puzzling plurality opinions. Justice Thomas recently referred to the Supreme Court’s treatment of the Clause as “a jurisprudence in shambles.” This term, the Court will revisit its Establishment Clause doctrine in Town of Greece v. Galloway. Will the Justices take this opportunity to embrace a new test? What would a cohesive Establishment Clause doctrine look like? Our speakers will address these contentious issues in a lively discussion panel
