IS THERE A CONSTITUTIONAL RIGHT TO E-GOVERNANCE?

||This symposium analyzes the legal basis for mandating online public notices, proposed rules, and related, supporting legal documents. It evaluates the specific benefits gained by the federal government’s investment in and deployment of its online public notice database, Regulations.gov, to determine if similar benefits can be achieved at the state and local levels. It also examines current barriers at the state and local level and explores whether a change to online notices requires a state constitutional amendment, a new statute, or simply a new interpretation of current statutes (federal and state APAs). Finally, it highlights new and emerging technologies available to accomplish the goal of online public notices.
