We the Corporations? An Analysis of Citizens United, the Constitutional Status of the Corporation and the Future of American Democracy

In Citizens United v. the Federal Elections Commission, the Supreme Court is now asking whether corporations should have unlimited rights under the First Amendment to spend money in political campaigns. With this decision, the Supreme Court could topple nearly a century of campaign finance regulation that has treated the private for-profit business corporation not as a citizen for political purposes but as an artificial legal entity designed by the state for purposes of wealth maximization. In this Founder's Event, we will examine the history of constitutional regulation of corporations and the conceptual and political dynamics in play in this case.
