This is an interdisciplinary symposium for scholars and practitioners from legal and business backgrounds, providing a spirited discussion of the challenges they face together.

The symposium is jointly organized by the Association of Corporate Counsel and the American University Business Law Review. It will include the following presentations:

Today’s hypercompetitive business environment means that it is as hard as ever to maintain a culture of ethics. However, increased regulatory oversight coupled with the swift dissemination of bad news makes staying ethical not only the right thing to do, but also the smart thing. This panel will cover the role of the general counsel in maintaining an ethical corporate culture and look at recent instances senior officers being held responsible for corporate wrongdoing even without direct involvement.

The discussion will go beyond addressing each side’s pain points and will share practical insight on combining expertise to secure a “win” for the corporate client.

Fighting to Serve: The Impact of the Transgender Military Ban

 The transgender military ban has implications for WCL students. The United States government has banned transgender people from serving in the military. This policy conflicts with DC law prohibiting discrimination on the basis of gender identity. It violates AU’s stated values and internal policies prohibiting discrimination.

At the same time, the federal “Solomon Amendment” compels the university to allow the military to recruit on campus, notwithstanding its discriminatory employment practices. This event will explore how the ban affects service members and the military, and how these conflicting rules impact the WCL community.

IP at Supreme Court Series: Peter v. Nantkwest

Issue:

Whether the phrase “[a]ll the expenses of the proceedings” in 35 U.S.C. § 145 encompasses the personnel expenses the United States Patent and Trademark Office incurs when its employees, including attorneys, defend the agency in Section 145 litigation.

American University Washington College of Law regularly invites counsel of record and counsel for selected amici to offer post-argument reflections in intellectual property (and related) cases heard by the Supreme Court. These events are held on the afternoon of oral argument before the Court.
