The March 2019 Proposals for Amendment of the ICSID Rules: A Discussion on Provocative Matters and Changes in the Latest Working Paper
The International Centre for the Settlement of Investment Disputes’ (ICSID) is currently going through the most extensive review of its rules and regulations that commenced in October 2016. The purpose of this review is to “modernize, simplify, and streamline the rules, while also leveraging information technology to reduce the environmental footprint of ICSID proceedings.” The ICSID Secretariat received comments from the public and Member States and developed an initial Working Paper (WP #1) in the Fall of 2018. After inviting and receiving suggestions from the public and Member States, ICSID published an updated Working Paper (WP #2), on March 15, 2019, to address the new proposals and to implement textual changes derived from these further suggestions. This panel discussion will cover various topics regarding the Rules and Regulations Amendment Process and provocative matters associated with changes between WP #1 and #2
