Handling Allegations of Corruption in International Arbitration and judicial Dispute Resolution

The issues to be discussed are how courts of justice and arbitral tribunals handle allegations of corruption in international and domestic commercial cases. This discussion is timely as in practice more and more parties attempt to reject the jurisdiction of courts of justice and arbitral tribunals on the ground that the contract at issue is tainted by corruption. This type of allegations have an impact on the admissibility of claims as well as on the merits. They also pose important questions on international and domestic public policy and the relationship of civil or private adjudication with the criminal justice system.
