The Geopolitics of Law in Latin America: Transnational Litigation and Investment Arbitration

Large money judgments may depend on qualitative assessments of foreign legal systems as a whole. Both transnational litigation and investor-state arbitration require adjudicators to decide on the fitness of foreign law at certain points. This presentation will critically discuss the evidence available for assessing Latin American legal systems in those contexts.

international criminal tribunal affects local communities and
the factors that account for its changing impact over time.
Drawing on interdisciplinary research as well as hundreds of interviews with Bosnian and Serbian citizens, the book
illuminates two questions at the heart of contemporary debate on international criminal tribunals: What goals can we plausibly assign to these tribunals, and what factors determine their impact on societies that have seen mass violence?
