Prof. Charles Duan filed an amicus brief in ASTM v. Public Resource

Assistant Professor Charles Duan filed an amicus brief in the ASTM v. Public Resource copyright case. The issue in the case was whether private publishers could stop the republication of legally mandatory texts. Public Resource republished various documents by private publishers online to make them more accessible to the general public. The American Society for Testing and Materials (ASTM) sued Public Resource for copyright infringement. The DC Circuit affirmed the district court in favor of Public Resource as the online post was a non-commercial use and therefore fair use under section 107.
Charles Duan designs and manages research projects at the intersection of intellectual property and public interest policy. His current research focuses on the impact of patent law on generic drug availability and scientific research, computer software copyrights, and competition and interoperability in digital markets. Duan is currently also a postdoctoral fellow at Cornell Tech and serves as a member of the Patent Public Advisory Committee of the U.S. Patent and Trademark Office.
