In 2016, the Justice Department issued a memorandum reaffirming its policy that transgender prisoners cannot be housed according to their anatomy alone but must be assigned to facilities on a case-by-case basis, with the inmate’s own sense of where he or she would be safest “given serious consideration .” However, transgender prisoners in many states continue to be housed according to their gender at birth — transgender women housed with men, transgender men housed with women. We invite states and local municipalities to share and/ or correct the information we have found regarding their policies on housing for transgender inmates.Read more
