Description
Explores the fundamental policies animating intellectual property jurisprudence and the extent to which "intellectual property" is "property." Students will explore the underlying policy goals and conflicts internal and external to intellectual property -- for example, the occasional tension between patent and copyright protection or between free speech and trademark protection. The course will also consider the responsibilities of various IP agencies and courts, and the relationship between state and federal governments in regulating intellectual products. Primary emphasis will be on the interrelations of all intellectual property protections, however, students will also learn the basic principles governing idea protection through the right of publicity, moral rights, trade secrets, unfair competition, copyrights, trademarks, and patents. This course is intended for students who are interested in a general overview of intellectual property, as well as students who are interested in an introduction to a more systematic and comprehensive study of intellectual property. . Students who take this course will not be eligible for the general IP survey course in the second, third or 4th years.
