Description
This seminar (formerly called Legal Aspects of Work and Parenting)studies
a number of statutes that regulate the workplace. The seminar contrasts
two types of statutes, those that prohibit employers from discriminating
and those that require employers to provide something to employees. In
this context the seminar compares "equal treatment" and "equal results"
theories of equality, and includes constitutional equality theory. The
seminar analyzes which statutes either prohibit employers from
discriminating against employees with families or require employers to
provide accommodations for family needs. It then analyzes statutes that
prohibit discrimination or require accommodations in other contexts to see
how they could be amended to enable men and women to have more time with
their children and other family members without jeopardizing their jobs or
careers. The seminar also considers needs of stay at home parents,
parents who work part time and single parents. It contrasts the needs of
employers with those of employees and includes some international
comparisons.
The seminar is two credits and requires a 20 page paper. The paper
can be
used to satisfy the upper level writing requirement if it is approximately
30 pages. Students have an option to receive one independent study credit
in addition to the two seminar credits if the paper is approximately 40
pages. Class time includes choosing paper topics and reviewing and
presenting draft papers.
