Description
This course will cover patent litigation and practice before U.S. Federal Courts. Through classroom discussion, written assignments and simulated exercises, students will explore a range of topics including pre-litigation considerations, pleadings, discovery, claim construction proceedings, motions practice, trial, and the use of technical experts. The course will focus not only on theory, but also on practical and policy considerations including the role of juries, the patent troll phenomenon, and the use of patent litigation as a business tool. PREREQUISITE: Students should complete Patent Law or obtain permission from the instructor before enrolling.
