in 1996, economic, social, and cultural rights have been protected and recognized rights. The South African Constitution has some of the most stringent protections for ESCR, but what does it mean to have these rights enshrined and protected? Are they meaningful and do they operate in reality, with remedies and recourse? Has South Africa really brought a legal revolution to the field of ESCR?
