Description

The Federal Regulatory Process course examines the practical side of the federal regulatory process. It provides an overview of the federal regulatory process, and it considers the underlying purpose of regulation -- to solve national problems. The course offers an overview of the Administrative Procedure Act (APA) processes of rulemaking and judicial review (but is not intended as a substitute for a traditional administrative law course). We will cover how agencies operate and interact with the public, and we will examine techniques to constrain the arbitrary exercise of administrative discretion. We will examine specific areas of federal regulation and will review efforts to enhance and revise APA processes. We will also include some guest lecturers who will provide a range of perspectives, including those from the executive and legislative branches, public interest groups, and private practice. By bringing real-world experience and expertise to the classroom, we will illustrate how the regulatory process works.
