Description
This course provides an overview of economic, social and cultural (ESC) rights in international and comparative law. It will examine both the theoretical debates raised by the emergence of ESC rights and the practical issues confronting monitoring bodies and advocates. The first part of the course explores the origins and emergence of ESC rights in international law and the status of ESC rights and corresponding State obligations. Part II of the course will explore the mecha-nisms that are established at domestic and international levels in order to ensure compliance with ESC rights: we shall examine the justiciability of ESC rights before domestic courts and regional bodies as well as the role of the Committee on Economic, Social and Cultural Rights and the role of special procedures of the Human Rights Council. Part III analyses ESC rights in the context of international development cooperation with a focus on extraterritorial obligations and the Sus-tainable Development Goals. The final part (part IV) will discuss various challenges for ESC rights in the context of economic globalization, which will involve a study of the relationship of ESC rights to trade and investment; their applicability to the activities of transnational corpora-tions; their relevance to international financial institutions.
