Description

Fair use has become a crucial part of the toolkit for any lawyer dealing with copyright issues. It governs not only the re-use of copyrighted works in the creation of new works (such as criticism, commentary, parody, and the like), but also a host of technological uses, from search engines to software reverse engineering. The statutory text is notoriously opaque, but the case law and practice on the ground is becoming remarkably consistent and predictable. This course will explore how courts are applying fair use and the ways that practicing lawyers can counsel their clients to take advantage of this powerful doctrine, and to avoid bringing lawsuits where a defendant is shielded by it.
