Description

This course provides an overview of the federal regulatory process, including the rationale for regulatory programs and reasons for starting, ending, or deregulating them, how and why Congress creates or abolishes agencies, how agencies administer their statutory programs through rulemaking, guidance, adjudications, and other tools, and alternatives to traditional regulation. It will examine the ways that the President, other parts of the White House, Congress, courts, and non-governmental actors influence and control agency actions, including through appointments, budgets, oversight, and other mechanisms. In addition, it will consider business and consumer regulation as a way to address market failures. The areas of regulation this course with examine include: financial regulation, including efforts to regulate cryptocurrency by the Securities and Exchange Commission (SEC) and challenges to the Consumer Financial Protection Bureau; environmental regulation, including recent Supreme Court decisions impacting the authority of the Environmental Protection Agency (EPA) to address climate change; immigration regulation, including the Department of Homeland Security’s creation of Deferred Action for Childhood Arrivals (DACA) and challenges to the program, changes in approaches across the last three presidential administrations, and Supreme Court decisions in this area; labor regulation, including the work of the Department of Labor and the National Labor Relations Board; implementation of the Bipartisan Infrastructure Law by the Department of Transportation; regulation of manufacturing, supply chain, and semiconductors by the Department of Commerce and other parts of the federal government; as well as other areas of regulation. Students will have one writing assignment and a final examination.
