Description

This course will focus on the role of the Supreme Court in interpreting and applying the Constitution, and how the modern, conservative-leaning Court’s approach could impact the trajectory of constitutional law. The course will cover different theoretical approaches to constitutional interpretation — including textualism, originalism, and functionalism or purposivism — and how those models shape the Court’s approach to individual rights and the scope of governmental power. We will read a series of recent or pending cases on pivotal constitutional doctrine, with particular emphasis on voting rights, abortion, guns, religion and the separation of powers. The aim of the course is to encourage students to engage with constitutional ambiguity and debate from the standpoint of competing constitutional theories. If feasible, the professor will arrange for a field trip to the Supreme Court. The final course grade will be based on class preparation, participation, and a semester-long writing project.
