Description

This course will provide students with a solid understanding of how the United States regulates foreign inbound investment for national security purposes, with a particular focus on how such reviews address the international transfer of data. The course will cover the national security bases for such reviews by the Committee on Foreign Investment in the United States (CFIUS), the process for conducting such reviews from the perspective of the private sector and U.S. government lawyers and policy makers, how the risks of data transfers and other national security risks are considered and addressed, and the judicial and legislative routes to challenging government action. In addition, the course will explore other ways to address national security concerns with foreign access to U.S. data and concerns about outbound investment. The course will also provide students with opportunities to make oral and written presentations and to receive prompt and concrete feedback. Outside speakers from the private sector bar and government will share their views and experiences.
