Description

Health Care Compliance: Privacy and Data Protection - 2 credits - Scielzo and Watterson - LAW-719F-001 This course will explore the importance of corporate compliance for health care organizations and key compliance guidance and principles. This course will emphasize privacy and data protection regulatory issues and challenges from a corporate compliance perspective. Lectures will use current compliance failures, including data breaches, as a teaching tool, and will delve into the specific elements of an effective compliance program. In addition to an in-depth review of compliance with the HIPAA Privacy, Security, and Breach Notification Rules, this course will survey other federal privacy laws, such as the Privacy Act, Part 2 regulations, and FERPA. This course also will examine when health care organizations need to comply with international privacy regulations and state breach and data security laws. With regards to corporate governance, the course will provide an overview of fiduciary duties, with emphasis on the specific challenges faced in the health care industry. The course will conclude with a discussion of how effective health care corporate compliance and privacy and data protection intersect. The teaching strategies for this course will include readings, lectures, and group discussions.
