Description

This section of Advanced Constitutional Law will study constitutional decisions in the economic regulatory area. It will focus on the contract clause, takings, substantive due process, commerce clause (and dormant commerce clause) and commercial speech regulation under the First Amendment. The first third of the course will trace the historical development of the constitutional supervision of state and federal legislation regulating the economy. The remainder will examine a range of modern controversies, including the ongoing dispute over the extent of congressional power to regulate health care (commerce clause issue only).
