Description

This course will survey international relationships among nations with respect to protecting copyrights. The survey will include reviewing aspects of the Berne Convention for the Protection of Literary and Artistic Works, the Agreement on Trade Related Aspects of Intellectual Property Rights (“TRIPS”), the WIPO Internet Treaties, and the [proposed] Anti-Counterfeiting Trade Agreement ("ACTA"). The course will also compare and contrast the U.S. approach to copyright protection with the approaches of some other nations. In the process, the course will consider how the U.S. has implemented (and/or failed to implement) its international promises as well as U.S. efforts to encourage enforcement of the rights of U.S. persons abroad. Finally, the course will consider new approaches to protecting expressive material internationally.
