Description

This course could be more accurately called Education and Federal Law. The course addresses a number of areas in which elementary, secondary and higher education intersect with federal constitutional protections and statutes. I have tried to provide cases that cover a wide range of federal law issues. We will address the issue whether education is a federal fundamental right, and how federal courts address the importance of education. We will study discrimination in the contexts of desegregation, harassment, and equality of opportunities based on sex under Title IX. We will also discuss the future of affirmative action in both higher education, and elementary and secondary education. We will also discuss the way in which religion and education coexist. We will then discuss students' and teachers’ rights, focusing primarily on First Amendment-free speech and (for students) disciplinary issues. We will then discuss the rights of children with disabilities to public education, focusing primarily on the Individuals With Disabilities Education Act (IDEA). We will discuss the ramifications of the No Child Left Behind Act, and discussion of the newly developing law about the rights of gay students to meet in school or to post notices about their off-campus meetings. As other subjects of interest to you arise, we may add those to the syllabus.

This will be an interesting class, as the issues we will discuss are complex and timely. I look forward to meeting you all.
