Description
This section of Advanced Constitutional Law will study constitutional decisions in the economic regulatory area. It will focus on the contract clause, takings, substantive due process, commerce clause (and dormant commerce clause) and commercial speech regulation under the First Amendment. The first half of the course will trace the historical development of the constitutional supervision of state and federal legislation regulating the economy; the second half will examine a range of modern controversies. The readings, mainly edited Supreme Court decisions, will be posted on the course web site. Evaluation will be based on class participation and a research paper.
