Description

This advanced criminal procedure course covers the criminal trial process from pre-trial to appeal and collateral review. Topics include prosecutorial discretion, grand jury, discovery and the Brady doctrine, guilty pleas and plea bargaining, speedy trial, constitutionally based proof requirements, jury trial, public trial, counsel and self-representation, sentencing, double jeopardy, direct appeal and federal habeas corpus.

CLASS PROBLEMS AND DISCUSSION ASSIGNMENTS: This course is structured around the use of problems and each class (except the initial and last classes) has a problem associated with it. Students will be assigned to argue for the prosecution or the defense on one of the problems during the course of the semester. All students in the class, however, are expected to be familiar with and to participate in the class and problem discussions.

CLASS ATTENDANCE: Mandatory for all classes. Please email both professors, in advance, with an explanation, if you are unable to attend class.

EXAM: 24-hour take home exam.

GRADING: Based on exam, class participation, and problem performance.
