Description

This two-credit course closely examines the legislative drafting process, including the tools needed for crafting effective legislation. Drafting guidelines and techniques are studied and regularly applied in exercises and in the final legislative project simulation; congressional rules and procedures and their impact on legislative drafting are analyzed; and trends in statutory interpretation are considered in order to provide insight into how drafting decisions affect judicial review and the ultimate success of legislation.

There are two required texts for the course; both can be purchased through Amazon.com or other establishments. Each is available in traditional book form or through Kindle. The other required readings will be posted and consist of selected excerpts from other texts, legislative rules and procedures, drafting guidance, current articles, and additional relevant materials. These will be available to you via the class website at MyWCL; and at times, I will email them to you directly.

Please purchase as soon as possible the following books: Congressional Procedures & the Policy Process, Eleventh Edition, by Walter Oleszek, Mark Oleszek, Elizabeth Rybicki, and Bill Heniff, Jr.; and Legislative Drafting-Step-By-Step, by Arthur Rynearson.

Copies of Chapters 1 and 2 of Legislation and Regulation-Cases and Materials, Third Edition, by John Manning and Matthew Stephenson will be posted on the website. Selected reading from those chapters will be posted on the course page.

First Class Readings

  • Review and be prepared to discuss the course description and goals.
  • Read Chapter 1 in Oleszek. Be prepared to discuss the reading in class.
