Description
This seminar introduces skills and tools necessary for successful written and oral advocacy in an international commercial arbitration. It builds on basic concepts of international commercial and investor-state arbitration, teaching students not only the mechanics of an international arbitration, but also the substantive law and policy considerations involved in the rapidly developing field of international arbitration. This course examines the principles and rules observed in the practice of international commercial arbitration against the backdrop of disputes arising under the Convention on the International Sale of Goods (CISG) during the first half of the term and focuses thereafter on the development of practical skills for the presentation of evidence and the delivery of oral pleadings in an international arbitration. The course will also direct student research in the specific area of substantive and procedural law presented by the Willem C. Vis International Arbitration Moot Court Competition (Vis Competition) problem. The class is limited to the students participating in the Vis Competition.
