Description
This course will examine the key legal principles, policies, and requirements that apply to the government’s efforts to protect the nation’s security, focusing primarily on tensions created by competing considerations in two areas: surveillance vs. privacy, and secrecy vs. transparency. The course will be taught from the perspective of a national security law practitioner, and will review the relevant constitutional framework, the collection and use of information for national security purposes, and the protection and release of classified information. Note that National Security Law: Use of Force will be taught in the Spring, and will examine the legal framework for the use of force to protect national security.
