Description
Criminal Procedure addresses constitutional issues arising under the Fourth, Fifth, and Sixth Amendments. The vast majority of the course will address substantive and remedial Fourth Amendment issues concerning searches and seizures and substantive and remedial Fifth Amendment issues concerning interrogation of suspects by law enforcement officers. We will also cover certain right-to-counsel issues under the Sixth Amendment, including the admissibility of uncounseled confessions and uncounseled pretrial line-ups, as well as the right to the effective assistance of counsel.

Note about reading assignments: For some classes, supplemental reading assignments are listed. They are usually one or more “syllabi” (i.e., short official case summaries) of Supreme Court opinions, which available on the Internet. (You do not need to read the entire Supreme Court case when I assign a syllabus.) The syllabus appears at the very beginning of a Supreme Court case. On a few occasions, a lower court decision is assigned. You can access those cases on Westlaw.
