Description
The class will provide an in-depth look at appellate advocacy, with a particular focus on the U.S. Courts of Appeals. We will begin with a study of appellate jurisdiction, including the final judgment rule and the many exceptions to that principle. We will then turn to a study of appellate brief writing, focusing on each part of the brief as set out in Rule 28 of the Federal Rules of Appellate Procedure. Next we will look at oral advocacy, with readings, in-class mini moot courts, and video viewing and analysis of sample oral arguments. The class aims to combine theory and practice. Students will each write an appellate brief and present an oral argument as part of the course, in addition to other hands-on assignments during the course of the semester.
