Description

This course broadly seeks to introduce students to the implications of gender constructs within international and comparative law and how such constructs affect the personhood of individuals and groups. At the core of this course is the question; how do gender constructs at the communal, national and international levels affect and impact the rights and obligations of individuals? Using an intersectional and transnational approach, we will examine domestic and international topics such as the legality of the person, access to justice, sexual and reproductive rights, political participation, access to decision-making bodies, development paradigms, migration and transnational trends in trafficking in persons.

Recognizing the historical, cultural and social context of the issues we discuss is essential to developing a nuanced and integrationist approach to the solutions we seek to develop. The course will therefore examine various methods and approaches used by social movements, civil society, and individual actors in advocating for the rights of minority groups at the domestic and international levels. We will interrogate the role of feminist institutional approaches in challenging and deconstructing received gender norms that seek to silence and limit the rights and opportunities for groups of people.

As a seminar, this course uses a collaborative learning approach, therefore active participation is encouraged as we draw on the experiences of all participants. At the end of the course, students should be able to identify, categorize and deconstruct gender from a transnational perspective. The goal is for students to develop new critical tools and strategies for challenging gender-based constructs from international and comparative perspectives.
