Description

Employment discrimination laws provide major, important exceptions to the United States’ default legal system of “employment at will.” An at-will employee can be fired for any reason or for no reason — but not for an unlawful reason. An employee who can prove discrimination or retaliation in the workplace that is the basis for an adverse employment action has legal recourse in ways that other employees who suffer adverse actions do not have. An employer who does not understand what conduct, comments, actions, and types of hostile workplace environments can create liability risks significant legal exposure, as well as other workplace and business consequences.

In this course, we will examine the substantive areas of employment discrimination law that arise under federal, state, and local laws. We will study theories of discrimination, including disparate treatment and disparate impact discrimination. We will analyze proof paradigms, including the use of direct evidence and the use of circumstantial evidence. We will focus on practical, “real world” examples of what is an what is not unlawful discrimination or retaliation.

The expected level of student participation and class discussion is high and will count towards the final grade. There will be an open-book, open notes final exam. There will be an opportunity to obtain extra credit by presenting a research memo during the course.
