Description

Topics covered include class actions, injunctions, duplicative litigation, appealable orders, res judicata and collateral estoppel. Students will gain practical experience in writing a motion for class certification which provides an opportunity to improve their writing skills and receive detailed feedback. The motions for class certification will be based on three fact patterns provided by the professor in areas such as employment law, securities law, and mass torts. Each students will be able to choose the area of his/her greatest substantive interest. There will also be a take-home final exam that also provides practical experience and will test the students’s ability to prepare a motion for an injunction, to determine whether an order is appealable, and to analyze issues presented when there are simultaneous proceedings in different courts.
