First Class Readings

Casebook: Criminal Procedure, Chemerinsky & Levenson, 2nd Ed., 2013 and 2014 Supplement
Publisher: Walters Kluwer

First Assignment:
Chemerinsky, pp. 12-16; 19-24

The course will address comprehensively the policies, laws and actual practices of criminal procedure. We will commence with police surveillance and investigations and conclude with indictments and other pre-trial steps.

The course will deal, in chronological order, with the various stages in police and prosecutorial work from: electronic and photographic surveillance to stop and frisk and arrest; the issuance of arrest and search warrants, to eye witness identification; police interrogations to self-incrimination; from release on bail to prosecutorial discretion; and, finally, concluding, with grand jury indictments and the right to jury trial.

The materials are challenging and designed to be of direct value and use not only to those contemplating criminal law, but also other trial careers.

The course will serve all future lawyers, regardless of specialization, members of the legal profession, who are deemed accountable for the country’s legal system, and are expected by both acquaintance and the general public, to respond competently and intelligently to the flood of news stories, films and criminal thrillers, which appeal to the citizens’ never ending curiosity about “crime and justice.”

Students will attend and observe segments of a “live” criminal trial. They will also have an opportunity to take part in a “live” interview with an experienced prosecutor.
