Description
Advanced Topics in Criminal Procedure will address in depth many of the constitutional and statutory procedural issues that commonly arise in complex criminal litigation in state and federal courts. Such topics will include the wide variety of pretrial motions filed by both prosecutors and defense counsel; discovery in criminal cases; bail practices; plea bargaining; jury selection strategies; jury instructions; sentencing issues (in both capital and non-capital cases); recurring procedural issues in criminal appellate practice (e.g., harmless-error analysis and retroactivity of "new rules"); and post-conviction habeas corpus litigation. This course will approach these issues from a practical, as well as doctrinal, perspective.
