Description

Focuses on employee rights and the implications, both within and beyond the workplace, of recognizing or not recognizing those rights. The course begins with a consideration of the fair treatment of the individual employee, including an examination of employment-at-will and the exceptions thereto, e.g., quasi-tort, public policy and whistle blowing. We also consider whether or not arbitration is a satisfactory means of dealing with these issues. Students then consider basic Title VII doctrine, emphasizing theories of actionability, harassment, conceptions of wrong and employer responsibility. We then consider the National labor Relations Act, emphasizing organizational rights, penalties, and legal and illegal economic pressure from employer and employees sides. We next examine health and safety in the workplace and workers compensation. Finally, in a global economy, we examine job security and capital mobility.
