Description

Health care fraud and its resultant increasing costs to taxpayers and the government have had an enormous adverse impact on patients, providers, payers, and workers. This class will examine in-depth fraud and abuse in the delivery of health care, a major priority of federal and state enforcement, through discussions of the major criminal and civil laws and regulations that combat various forms of health care fraud; health care anti-fraud enforcement efforts by the FBI and Department of Health and Human Services' Office of Inspector General; sanctions; and compliance programs. The course will be presented in lecture format, and will be enriched with frequent guests experienced in the field. There will be substantial opportunity for class participation. Readings will be assigned from Legal Issues in Health Care Fraud and Abuse by Carrie Valiant et al (AHLA), and supplemental course materials, including case reports, applicable statutes and regulations, other governmental issuances, and medical literature. The seminar will benefit students wishing to work in the health law field, as well as students interested in criminal litigation in general. The seminar will be evaluated on the basis of class participation and a final exam. 3 credits.
