Description

An examination of major legal and constitutional issues that have arisen in the aftermath of the 9/11 terrorist attack on the United States, including the legal status, interrogation and treatment of detainees/enemy combatants; the use of military tribunals and secret evidence in prosecutions of suspected terrorists; the Foreign Intelligence Surveillance Act; the USA PATRIOT Act; prosecutions for terrorist financing and other "material support" of terrorist organizations; legal authorities for covert action by the CIA and other intelligence agencies; reform of the U.S. intelligence community; ethnic profiling in airport security and immigration enforcement and the impact of data-mining and passenger profiling on privacy rights. The course will also focus on the changes in governmental structure and policy that this new kind of war has spawned. We will review the findings and recommendations of the 9/11 Commission and the Commission on Intelligence Relating to Weapons of Mass Destruction, and discuss the implementation of the reforms mandated by the Intelligence Reform and Terrorism Prevention Act of 2004.
