Description

The goal of this practical course is to guide students through the day-to-day procedure of international arbitrations in a way that will help them comprehend how the various complex arbitral rules and systems interrelate and prepare them for practice. Enabling students to behave and think as counsel in an arbitration or as members of a tribunal during realistic simulations and exercises will help them absorb the lessons learned in cases and articles, and apply the many different laws at play in international arbitrations. The course would include case readings, but is focused on application by taking students through the stages of a transnational dispute, promoting strategic thinking, and developing essential skills by requiring the drafting of pleadings and presentation of oral arguments based on legal knowledge and a specific set of facts. Each class will typically consist of general lecture and discussion of readings followed by student presentations and role playing exercises in which class members will actively engage with a hypothetical factual scenario.
