Description

This course is designed to provide a knowledge base and understanding of labor and employment law as it applies to immigrant workers, and will urge critical analysis of the development of the law governing the employer/employee relationship, particularly in low-wage industries (including temporary “guestworkers”). Specifically, the course will focus on rights and remedies (and exemptions, exceptions and exclusions) proscribed by statutory, regulatory and common law governing the following: right to pay (including minimum wage provisions and overtime); health and safety; the right to organize and collective bargaining; and non-discrimination. The course combines the instruction of labor and employment law as it applies largely to low-wage immigrant workers with a discussion of strategic choices to be made in this area of practice. It will also examine the theoretical underpinnings of the laws’ development and related policy issues, particularly as they intersect with immigration policy. The course will meet once a week for three hours. Course requirements include: readings and preparation for class; participation in in-class simulations; an oral presentation (10-15 minutes) and final paper (20-30 pages) on a related topic of choice. Students may use paper for this seminar to fulfill their Upper Level Writing Requirement (with approval of the instructor). There are no pre-requisites to this seminar, though previous experience in labor and/or employment law (either academic or practical) is encouraged.
