Description

As an area of law elder law has expanded greatly in the last 15 years. Since it is an area distinct to a particular population its range of issues are varied. Essentially we will be looking at advance planning and long-term care issues for both elderly and disabled populations. Students will receive a thorough understanding of the web of social benefits both income and health that attempt to support the elderly in America today. Such programs raise issues of policy which we will discuss. Subject areas include incapacity; guardianship; death & dying; advance planning both financial and health; social security; medicare; medicaid; nursing and assisted living facilities. All of this will be presented in the context of legal problem solving.

Course Requirements Weekly hypothetical problems and paper which can be used to satisfy the upper level writing requirement.
