Description
This course will supplement your education in immigration and nationality law in examining the ethical issues that confound our field. Whether you intend to represent immigrant clients or work for the United States government, the consequences of your advocacy will have a profound effect on people; in many cases, it could be the difference between someone staying in or leaving the United States. Whatever your goal, these life-altering costs demand competence, zealous representation, and the just administration of your important role in the process. This course will explore the areas where immigration and nationality law intersects with ethics and the rules of professional conduct. Topics will include the unauthorized practice of law, access to competent legal representation, challenges related to representing immigrants that are either children or lack mental competency, dual representation and other ethical dilemmas raised in benefits applications before the United States Citizenship and Immigration Service (USCIS), ethical best practices when appearing before the Executive Office for Immigration Review (EOIR), ineffective assistance of counsel, and issues that may arise when litigating asylum applications, such as credibility and confidentiality. The course will also provide students with the opportunity to exercise practical skills in drafting a mock trial or appellate brief or motion before the EOIR, as well as the opportunity to comment on how best to reform ethical quandaries that are currently perpetuated in our system. By the end of this course, you will gain an appreciation for why immigration and nationality law is ethically unique, understand how comprehensive immigration law can be given its broad reach into other areas of law, and internalize best practices when faced with any ethical dilemma that may arise in this complex discipline.
