Description

Environmentally-induced migration has emerged as a significant concern for national governments and for the international system. Over the last few decades, scholars and policy makers have detailed the links between different environmental phenomena and displacement, noting the complex web of factors that can culminate in either internal or cross-border migration. While the precise contours of "environmental migration" as a category remain contested, there is growing consensus around the need for legal frameworks that assign rights and responsibilities. This course explores efforts undertaken at the international and domestic levels to enact legal protections for environmental migrants, including national laws, multilateral initiatives and instruments, and strategic litigation. The course also considers the practical, legal, and political factors that have impeded the development of meaningful legal frameworks. This course is recommended for students interested in immigration and refugee law, human rights, international law, and/or environmental law.
