Description

This one-credit summer course revolves around the phases that regularly are followed by a mediator during a mediation. Each phase will be examined and discussed, and then participants will role-play as mediators and advocates in order to acquire the practice skills that complement the theoretical foundation provided at the outset of the course. Participants will have received feedback from the instructors during the exercise so that they can learn from experience and that of their peers. Finally, the course will provide an overview of the issues associated with mediator ethics, ethical challenges during the mediation process and acquiring experience in the field. Class materials will be available two weeks before the class starts through MyWCL at https://my.wcl.american.edu The final examination requires students to provide two different essays. The first is a memorandum written as legal counsel to a client explaining what to expect from the mediation process and how to best take advantage of the opportunities it offered. The second, consists in an example of what the students would say in their opening statement to parties participating in a mediation. The paper must be uploaded by August 1, 2017 through MyWCL.
