Description
This seminar is intended to provide students with the opportunity to engage in intensive research into various aspects of International Investment Law with a view to gaining specialization in a chosen area, and to develop advocacy skills in the discipline. The ultimate objective is the presentation of a research paper which can be further developed for publication. Ideally, students should have taken the course on International Law of Foreign Investment, or courses on Bilateral Investment Treaties, International Commercial Arbitration, or similar courses, although, this is not a requirement. This seminar will be suitable for those students interested in pursuing legal careers in international investment law and investor-State arbitration. Students will be required to undertake independent and in depth research into a selected aspect of international investment law, including, but not limited to: what constitutes a “foreign investment”; establishing the nationality of claims; attribution and State Responsibility; expropriation, nationalization and similar acts; breaches of contractual obligations; the Fair and Equitable Treatment Standard and other treaty applications; compensation; political risks and sovereign immunity. Students are expected to make presentations on their research subject and explain the findings among their peers. Experienced practitioners in the field will be scheduled to make presentations on specific aspects and provide guidance. The final research paper will constitute 75% of the grade, and class presentations and participation will constitute 25% of the grade. (The required paper will satisfy the upper level writing requirements both for JD and LL.M. candidates).
